    Default Can a Teenager Marry Without Parental Consent if She's Pregnant

    My question involves marriage law for the State of: West Virginia

    My boyfriend is 18 and Iím 16 and pregnant. We both know my parents wonít consent to it but is there any way we can get married without their consent?

    Note that being pregnant is not one of the things the court wants to see to prove you have a need to be emancipated. In fact, it might show that you need MORE supervision, not less. You can certainly try to petition the court for emancipation, but unless you are ready to show how YOU will support yourself AND stay in school (without financial aid and handouts from others), then your odds of success are near nil.

    Flat answer - no.

    There is no state in the US where a minor, pregnant or not, can marry without parental permission, permission from the court, or both. You may rest assured that the chances that a judge will grant a pregnant 16 year old permission to marry in defiance of her parents' wishes to be something less than your chances of being hit by lightning, sitting down next to Elvis on the bus and winning the lottery all on the same day.

    Pursuant to West Virginia Statutes, Sec. 48-2-301, a minor aged sixteen or older must have consent from her parent(s) or guardian in order to marry. Minors under the age of 16 require court approval, but there's no option for seeking court approval that would override parental wishes for a minor aged sixteen or older.

    And just to clarify (though it doesn't apply here), in order for the judge to approve an under-16 marriage, the parents must also consent.

    Thanks for the clarification, Mr. K and Ron. The point I was trying to make was that she can't run away to another state and get judicial permission, but I didn't word it very well.
