    Default What Actions Can Result in Charges for Communicating Threats

    How clear do texts have to be to be considered communicating threats? If things were said like I wish I had the opportunity to show you bad, i wouldn’t need help to handle you, and I wish you weren’t pregnant so I could invite you to my house so you could talk s***t ... are these considered communicating threats?

    What state are you in?

    If the person had reason to fear harm as a result of what you said, you likely could be charged with that.
    Generally, you should avoid sending such communications to people who do not wish to converse with you.

    I am in North Carolina. We work together, and have worked right next to me since. She actually was suspended from work after this for yelling in my face “meet me outside” I’ll whoop your ass. In the texts it’s clear this is a back and forth disagreement...

    I’m worried she will press charges on me. I am a nurse (so is she) she did actually blatantly threaten me. I don’t want to take legal action I just want it to go away but should I press charges/restraining order before she does?

    You should do absolutely nothing. You have not posted anything to suggest that she has any kind of valid claim against you, and in the event that there is something you conveniently left out you don't want to be drawing attention to yourself. Do nothing, and the likelihood is that it will all go away. Start trying to take measures to "protect" yourself from things that haven't happened yet and may never happen, and you just may be stirring the pot.

    There will be plenty of time to take any kind of relevant action in the unlikely event that she takes things further.

    NO. YOU SHOULD NOT PRESS CHARGES/RESTRAINING ORDERS BEFORE SHE DOES. Go back and read my post again.

    You are both behaving like five year olds and if she goes to the police or an attorney about you that is exactly what they will tell her. You both need to be slapped upside the head and told to straighten up. The legal system is not there to make adults who should know better play nicely in the sandbox together. You both have a better chance of being fired for your behavior than you do having any kind of charges or restraining order put on you. I wouldn't want a nurse on my case who behaved as childishly as you two are doing. Grow up and act like an adult. Both of you.

    That was an accident I didn’t mean to post that twice. I am not going to do anything I don’t think I’ve done anything illegal and it would be wrong of me to press a restraining order when I don’t actually feel afraid of her. Thank u for your advice
