    Default Researching H.R. Laws for East Coast States

    My question involves labor and employment law for the state of: east coast

    I am interviewing for a (for profit private company) job that will have HR responsibilities for the east coast regions - which means many states I am not used to. I will have a peer HRBP that will have been the person that used to be responsible for this region (they are creating a new position and splitting her coverage). If you practice HR in any East coast state (like cbg in Mass or Elle in MD and others), I'd love to know about any oddball laws/policies in your states that someone from the outside might be unaware of -- or any links to any great state employment websites ( I am spoiled as TX has a really good one but TX will not be in my region although it has a lot of federal information where TX doesn't have anything itself). I had a "final" interview today where I was told by a C level that I definitely had the experience and the fit that they want. So here's hoping for an offer soon! I really need out of my current telecommuting position (lack of work is driving me bonkers!)

    I am planning on creating a chart once I know exactly which states are in my region (but definitely know Mass and MD are)..... I am pretty solid on the federal level, so looking at more of the state level. And if anyone wants to brainstorm topics, here's what I have so far in no particular order:

    (1) wage laws - allowable garnishments, forced direct deposit, PTO payout at term, accrued mandatory sick time, etc
    (2) employee file availability, new hire requirements
    (3) Unemployment benefits
    (4) workers compensation
    (5) state level protected leaves that mirror FMLA
    (6) state level EEOC


    Any help would be greatly appreciated!!!

    Yeah, that's why I am trying to get a small head start!
    I think I am ready for it -- luckily I will have others on my team that will handle payroll, recruiting, etc (those parts that I currently dislike the most)

    A handy chart of each state’s protected characteristics by the National Conference of State Legislatures (NCSL) is useful as quick starting point on state employment discrimination issues.

    (5) state level protected leaves that mirror FMLA

    Not that I doubt cbg will point it out, but my personal favorite is the Small Necessities Leave Act. I miss it!

    What does the SNLA do? It grants an FMLA-eligible employee a total of 24 hours of unpaid leave during any twelve-month period, in addition to any leave the employee was entitled to under the FMLA.

    The SNLA is enacted at Chapter 149, § 52D, of the Massachusetts General Laws. The Massachusetts Attorney has also enacted regulations at 940 Code Mass. Regs. § 20.00.

    What are these “small necessities” covered by the SNLA? It covers a variety of important activities that an employee might need a few extra hours for. For example, parent-teacher conferences, medical appointments, helping elderly relatives attend medical or other professional appointments, or other meetings related to the employee’s child’s “educational advancement.

    Oh wow, "small necessities leave" How I could've used that in my working career! I am just so impressed by all those nice little things for employees they throw in the mix at a state level in some of the the eastern states!

    HR, what you're going to be dealing with is a move from the southern POV to the north and eastern POV in regard to HR. It will be a change. For starters in U.I. compare the max benefit amount in Texas with the max benefit amount in Massachusetts. There is really a different point of view at work here. Be sure you work with the state's DOL as they will probably be very willing to provide you with lots of helpful information about unemployment insurance in your new environment. We were sometimes accused of being "pro-employee" even in our area, but honestly, it was because so often, the employers assumed we'd be adversarial and approached us as such. Ask for help and information from the various state agencies, I believe you'll find them mostly quite willing to help.

    And I have another one, also from the NCSL that provided a summary of each state’s family and medical leave laws.

    The U.S. Department of Labor has a nice map for each state’s minimum wage laws.

    I could not have survived without this book, back when I was managing HR for a company that had 120 employees divided between 13 offices in 10 states.

    Nolo has a lot of good books for this kind of material. Recommend highly.

    And of course, you know that I am (or at least was - I've been doing nothing but Benefits for 10 years) the State Law Lady back in the old AHI days. Don't hesitate to shout!

    @cbg -- I thought you had some type of state chart back in the day! I miss AHI!

    Thanks to all for the suggestions. It's going to be a learning curve, but I am really ready for something new!
