    Default Statutory Rape question

    Hi, i have a cousin who is 21 and his girlfriend is 15 and i told him that he should becareful because he could end up going to prison my question is he says that his girlfriends parents know because he spoke to them before going out with her. If for any reason her parents were to press charges on him would her parents get in any type of trouble for giving him consent and i know their consent means nothing when breaking the law, but would anything happen to them. Second question because he keeps arguing with me is, he tells me there is no proof how would that work out how could he be charged with something that there is no physical evidence for. I don't know if he has had sex with his girlfriend but what if the parents just assume and press charges.

    Unless they have sex there is no crime. This would include serious fondling or digit penetration. Now the paretns giving permission to date in n ot illegal if they give permission to engage is sex acts or knowlinglyu allwo two to continue datingonce they know they hacve had sex or engaged in other illegal behavior then yes parents could be inm trouble as well. No 21 year old is goping to be ok with just a kiss goodnight for long! My advice is the 21 year old needs to date girls his age!

    Thanks for the info and i told him the samething, but his chose he's the one who is aona have to deal with the consequences. Other question is how does a court go about this because i read all these stories about guys going to jail because of the statutory rape charge besides of word of mouth what evidence does the court need in order to sentence this charge on a person. because i know a couple of people going out with younger girl not as intense in age but it would be consider illegal because in Illinois isn't the llegal age 17.

    The biggest potential traps are (a) somebody she tells acts as a witness, subject to hearsay exceptions for sex offenses against minors; (b) she gets mad at him and cooperates with the police; (c) she gets pregnant.

    Nobody can tell you what you seem to want, which is "How can he get away with it." If he wants to commit felony sex crimes and risk a potential prison term and having to register as a sex offender for the rest of his life, that's a price he's apparently willing to pay.
