    Default What is the Penalty for Failure to Return to Lawful Detention

    My question involves criminal law for the state of: Indiana
    My roommates boyfriend was in work release in Hamilton County. The other day he was at work and decided he didn’t want to go back. We know he now has a F6 Failure to return to lawful detention over his head but our question is how long could the sentence be??

    He could get up to 2 1/2 years on the new charge, plus whatever is left over on his original sentence (work release/probation is likely going to be revoked).

    Anywhere from 6 months to 2/5 years plus whatever was left on his sentence from the original charge.

    If you are allowing him to stay with you, you could also face charges. So if he's there, he needs to get to steppin'.
