    Default Charges for Evading the Police and a Resulting Car Accident

    My question involves criminal law for the state of: Texas

    Please disregard the long post, but I feel I should not leave out any details in such a high profile case, in order to receive best help. I'm hoping there is an attorney out there that could at least cover some of my questions under good faith. Please note to law enforcement, this post is posted in a secure manner and the connection has been routed through a Tor server, using VPN's with no trace left behind.

    My case, details, background, and questions.

    Background:
    I'm a prior felon, with a few felonies (all committed between ages 18 - 21). I spent a total of three years in the prison system on these cases. I was released on parole supervision. I then caught a new case, details will be explained below, which violated my parole, I chose to run, with 3.5 years left on parole.

    New Cases and Violation:

    I was involved in an evading in a motor vehicle case, which resulted in me crashing. When crashing, I wrecked into a ditch, then the officer rammed his car into my vehicle. I was charged with Aggravated Assault with a deadly weapon on a public servant, along with evading in a motor vehicle. The assault case is high profile, yet the least of my worries. I (DID NOT) assault an officer, I was injured and accused of a crime (I DID NOT COMMIT.) With that said, I did evade, and knowingly committed a felony. I was injured on the scene and released due to medical issues from the officer hitting me.

    After being released from the hospital, I chose to run from the above cases, along with my parole. Stupid, yes I know. With that said, it has been nearly a decade on the run and looking over my shoulder. Over this decade, I transformed my life. I no longer look at myself as a criminal. In fact, I left and moved on from all associates. I've went into business, started three different businesses, and have became quite successful. I'm to a point in my life, to where I regret what I did, but I feel I was done wrong, by being charged with a charge, in which the officer lied, and I did not commit.

    Ten years down the road, I still have not been convicted. I've became very successful in life. However, one day I have hopes to clear my name. Over this ten years, I've been stopped, pulled over, arrested for driving without a license. My parole expiration date has passed. For some reason when arrested for driving without a license, my blue warrant never showed up. My paid lawyer looked this up, still cannot find a blue warrant for parole, yet I have two active warrants from this corrupt county for evading and assault.

    My question is, after 10 long years, what should my expectations be from this case? I have a business, I feel could really be an asset and save the county lots of money potentially. (After-all) this is all about MONEY, right? If I were to be giving probation, they would collect fee's monthly, right? And they also want a conviction, right?

    I'm not at all worried about the assault, as I simply know from my heart, I'm not guilty. However, the evading case, I am guilty of. After ten years, could I expect this county to be willing to work with me on it?

    I'm willing to take the conviction, sign a probation order, and offer my services to the county under a work order from my business, that could save them in excess of $10,000.00 or more in county expenses.

    My question, is this a reasonable ple-bargain? Would it be reasonable to expect a county to work with me after 10-years on the run in exchange or a conviction, probation, money, and my services under something such as a work order? Do I have reasonable expectations?

    I would really like to get this behind me. As of now, the case is going no-where. I'm completely anonymous. I have a new identity, new name, new social, completely new information. They are NOT finding me. Does it sound reasonable, that they would at all work with me in exchange for the money, my services, and a conviction?

    No, it is not just about money. It is also about enforcing the law and public safety. The state has charged you with offenses and those charges may hang out there for decades. While you have been fortunate not to have been picked up on warrants up to this point, there is no guarantee that will continue. The only way to know what you might be able to work out on this if you surrendered to the court on this is to contact a criminal defense in the county where the charges are pending and ask. A lot depends on the exact charges and the attitudes of the prosecutors and judges in that county, of which no one here is going to have any knowledge. The sooner you resolve it and get it behind the sooner you will no longer have to keep worrying when it may catch up with you and potentially derail the successful life you have built.

    TaxingMaters, this is not the response I wanted to hear, but I'm at least happy that you gave me a cut and dry answer instead of lying. I understand the common response is, turn yourself in. However, I've built a heck of a life under a whole new identity, I've left all my criminal life in the past, and have built three solid businesses generating more than enough revenue to keep me happy for life. I'm satisfied with myself and where I am. I went from being a criminal to a suit and tie type of guy, and I feel I've made more progress by myself than I did when the state was looking over my shoulder. I understand the common response, "turn yourself in", but as I've said, I turn myself in, and I go right back to prison, I lose everything I've worked for, and worse of all, the state throws you back in the penitentiary to get involved and associate with the same very gangs that I risked my life trying to escape from. I've since had children, established a livelihood for myself, and made someone of myself. If I go back, there is no resolving anything. I left a cartel, I left a violent group, the state can claim to "hide" you, but they can't hide me from them from behind bars. It's either live the life I'm living right now, or death, and common sense tells me which route to take. I feel the circumstances would have been different at the time, and I would have been more than willing to take my time for the crime that I did commit, but when they threw in bogus extra charges, I feel I was done wrong, and I was also a victim myself. Over this decade, the same county in which filed the bogus charge, along with the legit charge, has been investigated by the Feds under Corruption, nearly half of the county officials have been wiped and fired. I'd rather not play with my life from behind bars while negotiating with a corrupt county, who'm can't even be honest about charges that could cost someone their life. One thing I learned in the prison system is you have to give respect, to get respect. This county done me wrong severely, and is playing with my life, freedom, and family. I feel if they feel the need to lie and do me wrong, then it is what it is. They are not going to get any honesty and respect from me, by me coming forward. So onto the next decade we go I guess.

    It is precisely because you don’t want your life derailed suddenly that you want to consult an attorney in the county where the charges were filed for help. I would certainly not recommend turning yourself in cold without first discussing it with an attorney. The attorney may be able to work things out to smooth the process of resolving the charges without landing you in jail or prison for some extended period of time. It may be possible to plea things down to something that would result in only fines and/or probation, for example. Until you consult an attorney to sort this out you won’t what options may be available to you. At very least once you know what the options and possible outcomes are you can make a more informed choice on what you will do.

    An attorney will likely advise you that one of the biggest issues you're going to have is running out on your parole. Most often, when that happens, the person will be incarcerated for the remainder of the term because they have theoretically demonstrated that they are not suitable for parole. I would anticipate having to serve that backup time. Now, I understand in your mind you believe you did not commit aggravated assault on the police officer, but that charge is still there. It will not go away just because you say you didn't do it. It may be bargained away as part of a global plea, but running out on the parole is going to work against you regardless. Any new law violation while on parole is bad. You desperately need to talk with a criminal attorney in the jurisdiction where this is based. There are huge variations between jurisdictions within the same state. An attorney who is familiar with the judges and prosecutors in your jurisdiction can give you the best advice.

    Maybe so, but it's reality.

    You either turn yourself in with a good attorney to front for you and mitigate the consequences or don't turn yourself in and someday, when you least expect it and at the most inconvenient, you get caught and sent to prison.

    Sure, it's a tough choice but you're the only one who can make it.

    County? Or Country?

    Either way, nobody done you wrong but yourself.
