    Default Seeking Custody With No Prior Custody Order

    My question involves a child custody case from the State of: Connecticut

    Hi all. It has been crazy.

    My girlfriend and I broke up about 3 months ago. We have 2 daughters, 11 and 13. My ex has gone insane. Has a new boyfriend, a felony just out. Has been using substances, drinking, and there has been major verbal and emotional abuse, and minor physical abuse.

    To make a long story short, she has started demanding money from me, to the tune of thousands. Stole my car, (which was in both of our names so nothing I can do) broken into my apartment and cleaned me out. The burglary has resulted in a felony warrant. She has now been keeping the kids from me, hiding them when it's been our scheduled time, and bringing them to school late so I can't get them.

    There is no current custody order, we were amicable until the boyfriend entered the picture. The car is still missing. DCF is involved, but can't do anything until allegations are proven. I want them out of there. DCF has already deemed my apartment safe.

    I want to file ex parte custody and permanent physical custody, what do I do and what are my chances?

    If the mother is presently wanted on a felony warrant, perhaps if you file a custody case the court might deem that to be a basis to grant an ex parte order; but you should anticipate that the court will want to follow proper procedure and give your ex- notice of the proceeding and an opportunity to participate.

    We lack sufficient information to comment on your chances of getting primary physical custody. Unless your ex- is incarcerated, it's going to depend upon whether the court finds your allegations to be credible, and its analysis of the children's best interest. You apparently chose to leave the children with your ex- three months back, even if there have been unexpected problems since, and that lends credibility to any argument that she makes that she's the primary caregiver and that, at least as of three months ago, you effectively deemed her to be a fit parent and the appropriate primary custodian.

    You need to go to court ASAP and file for custody. I would also go at least find a lawyer who does free consultations and get some advice from them to start with. I wouldn't wait I would just go file.
