    Default What Will Be the Sentence for a Weapons Offense

    My question involves criminal law for the state of: Arizona

    Hello thank you for reading my question, my friend was charged with

    (1) Count of DSCHG FIREARM AT NONRESIDENCE
    (1) Count of DISORD CONDUCT-WEAPON/INSTR
    (1) Count of DSCHRG FIREARM IN CITY LIMIT
    (3) Counts of ASSAULT-INTENT/RECKLESS/INJURE
    (1) Count of CRIMINAL DAMAGE-DEFACE

    He is in jail, But what is he looking at getting? like average amount of sentencing?

    his prior criminal record is for the most part pretty clean.

    There isn't any real way to tell what an "average amount" is, even with the charges. It will come down to what, if any deal, his attorney can work out. Given the charges, he is looking at a minimum of some prison time. At least one of those charges has a mandatory prison term associated with it. A "pretty clean" record means he does have priors. What those are may influence what, if any deal, the prosecution is willing to offer.

    DISCHG FIREARM AT NONRESIDENCE: Class 3 Felony
    DISORD CONDUCT-WEAPON/INSTR: Class 6 Felony
    DSCHRG FIREARM IN CITY LIMIT: Class 6 Felony
    ASSAULT-INTENT/RECKLESS/INJURE: Misdemeanor various degrees depending on the exact charge.
    CRIMINAL DAMAGE-DEFACE: Misdemeanor or Class 6 Felony depending on damage.

    The class 3 felony is good for up to 3.5 years. The class 6 felony for a year. The misdemeanors up to six months. This is the presumptive range, could be more if there are aggrevating factors (and based on the subjects prior record).

    This is quite a laundry list of charges. Let me guess. He shot three bullets at some structure? Chances are he's not going to be convicted of all of these counts. Depending on just what the situation is and what his previous record was, he could get anything from "time served" up to a couple of years I would guess.

    Who are you in all this?

    I don't know of any past offenses he has done buy I know it is very minor things compared to these charges. I will let him know of ur advice and encourage him to get in touch with a attorney to help him

    Im was given the facts of what actually happened by messages that were relayed to me by a couple of different people, and for that reason I'm not sure of exactly what happened that had law enforement place those charges against him, but that being said I think he shot the bullets in the air.

    hes a good kid, but was always a hot tempared individual, .

    Has he been arraigned? Is he indigent? If so, did he request a public defender?

    Felony charges are nothing to sneeze at. Yes he needs an attorney, as free9man says, if he's indigent he should get a public defender.

    Sounds like from the charges it was more than "in the air." It appears he hit something (hence the first and last charge). However, it appears he wasn't specifically targeting a person or else there would be more serious ADW charges in the mix.

    honestly I'm not sure, but this happened yesterday.

    this incident occurred in Maricopa County, AZ, so I'm not from there , nor do I live in Arizona, but I think these are different incidents that involving a fire arm misused.

    That's hilarious. What does that mean exactly? Oh wait, he's your "friend" in another state and you have no idea. You also don't know what the details are that led to his arrest.

    Your "friend" needs to be dealing with his attorney, not you. His attorney would have all of the information necessary in order to make a guess as to how he'll make out in the end, if anyone can.
