    Default Notice for Termination of Tenancy Based on False Allegations

    My question involves defamation in the state of: MN

    My building managers boss claims that I was given a non renewal because I am harassing other tenets and that many of the other tenets are afraid of me. He claims I posted multiple profanity filled notes on other tenets doors. I was shown one of the notes by the building manager. It was bad and had no signature but it was printed and I do not own a printer. I am a gamer and have a rig build to handle blizzard games but I have no use for a printer. I am also an introvert with Aspergers who is afraid of their own shadow.

    I am being given a non renewal on these claims, or so he says. The non renewal came 2 days after I had the building inspector here to try to get them to fix a hole that the building managers sons pot has been coming in my apartment through for the last year. In my state giving a non renewal after the building inspector was here is called landlord retaliation if it is done within 90 days of the building inspector being called. But this is his entire defense. I have had two officers up here on different occasions that could smell the pot coming from a lower unit.

    The man below me don't smoke pot and the other unit is the one that the building managers sons girlfriend lives in. The building managers son also has a criminal record from last year for possession. The building managers boss said I was lying about the pot and made the whole story up and then came up with this whole line that I wrote all these profanity filled notes and posted them around on other tenets doors and that they are all afraid of me now. I am on a Hello basis with half the tenets in this building. The only ones who have an issue with me are the building managers son and his friends who are doing the drugs and they have been stalking me since it came out. I suspect that they staged the notes as I never saw any posted.

    I do not know how to prove I did not write them. I do not have easy access to any printers and I do not know where they were posted, when or anything about them. I was given a lease violation for them and then he put it in writing in response to me challenging the non renewal. I really do not want to stay now but all that is open at this time of year are the worst of the worst. I am trying to buy time to save up because this situation is bad. I am not sure how to prove I didn't write these. I suspect that if they had proof that I wrote them I would have had legal actions taken against me and not just have been given a non renewal. He did put all this in writing for me and he started with the the fact that I called the cops and the building inspector.

    I have never had lease violations until I started dealing with this company. They don't tell you what you did they just give a letter stating that there was harassment coming from your apartment. I did not find out about the notes until 4 days after I was given the non renewal. I do not know what to do to prove my innocence and not be forced out onto the street. That is where it looks like my only option will be unless someone else moves from one of the good areas. This is a college town

    In court they would have to prove you wrote the notes. To get this into court you would have to disobey the non-renewal notice, stay put, pay your rent when due, and allow the owner to file for eviction in court where it's anybody's guess as to who would win. You could raise the retaliation defense per 504B.441 and 504B.285.

    But if you win all you are left with is being able to remain in an obviously hostile environment (until they try something more subtle or escalate the hostility) and you'd still have the attempted eviction on your record.

    An alternative is for you to file suit seeking an injunction to prevent the termination. Again, whether you are successful or not is impossible to predict.

    It seems obvious that you are being stepped on, but obvious is not evidence and you run the real risk of losing the eviction and having it on your record which would make it difficult for you to get a decent place to live going forward.

    Well I talked to the landlord the other day and it seems like I pretty much have to move out. I’m giving my notice to vacate and I’m getting my stuff packed up. Thanks I guess to the people here who tried to help and give me good advice. I guess I’m the future I probably will be very leery of offers to help from women because it seems they usually have strings attached. Happy holidays to the good ones. I wouldn’t wish this for anyone.
