    Default Can You Get a City Parking Ticket in a Store Parking Lot

    My question involves a traffic ticket from the state of: California

    Hello,

    I was parked in front of Target in the city of Gardena, CA last month. I was stopped there next to the red Target bollards to receive my wife and several of her packages from shopping. I was sitting there for approximately 1-2 minutes. During that time, the city of Gardena parking enforcement must have pulled in behind me and wrote me a ticket for $72 for being parked in a fire lane. We loaded our packages and moved along. I received the ticket later in the mail.

    I'm trying to determine a couple things, first if Gardena has the ability to ticket on private property. Second, what signage or combination of markings constitutes a fire lane, especially in front of a busy retail location. There was no signage present and I can't recall if the curb was red or not but since Target's primary color is red, it could have been mistaken for decoration.

    What was the code section?

    If the curb was red, it generally also requires that the "fire lane" be designated by a sign or labeled on the curb. If that was what you were cited for, and you do not know if there was a marked, red curb or signage, then how would you contest the citation?

    Oh, and yes, the city DOES have the ability to cite for fire lane violations on private property. Who do you think does it?

    Painted curbs are not a decoration and the curb is clearly painted red which means no stopping, standing or parking. There is a clearly marked yellow curb/sloped area just south which is allows for picking up passengers and packages. Gardena police have authority to enforce vehicle code violations in public parking lots. Stopping, standing or parking along a red curb is a violation of CVC 22500.

    However, a "fire lane" must be specifically designated as such. A red curb, alone, is not sufficient to support a citation for violating a fire lane. (VC 22500.1)

    To be specific, the code was 22500.1.

    Thanks for the information, it's all very helpful. I plan on returning to the site and taking several photos to make my determination. I do not believe the site had the correct markings on the curb or provided the appropriate signs as designated in the statute. I also believe the curb was not properly designated as a fire lane by the fire department or fire district with jurisdiction over the area in which the place is located. Thanks for the replies!

    Look for the curb markings or signs, the designation itself can come from many sources even the planning commission or council that approved the plans for the parking lot. If there are curb markings or signs, you should probably pay the fine and move on.

    10.28.180 Curb markings.
    The traffic authority is authorized, subject to the provisions and limitations of this chapter, to place, or cause to be placed, and when required shall place, or cause to be placed, the following curb markings to indicate parking or standing regulations, and such curb markings shall have the meanings set forth in this section:

    Based on all the images I've seen of the Gardena Target, their front curbs are clearly painted red, per the municipal code. If you were cited for the muni code you have an uphill battle.

    ^^^I missed the post where you said it was 22500.1 VC. Let us know what you photo taking expedition uncovers.

    Does that Target store not have designated 'package pickup' parking spots? Most of the targets are converting a few of their closest parking spots for that specific purpose.
