    Default Can You Sign Away Your Rights to Your Child to Stop Child Support

    My question involves a child custody case from the State of: TN

    My 14 year old son wants absolutely nothing to do with me, and his mother supports that. I have 50/50 custody but he refuses to see me and wants me to not exercise my rights to see him, pretty much asking me to sign away my rights. I was extremely active in his life until his mother remarried and completely replaced me as a father. They have alienated him to get more parenting time and child support. If I weren't in the picture, the new stepfather would certainly adopt him, but since I'm here, they don't want him adopted solely because they want to drain me of child support while giving me not parental rights to see my son. I have tried for over a year and failed to get him to see me. I'm heartbroken and give up.

    Can I (through attorney) petition the court to give up my parenting rights and responsibilities even if they don't want to adopt him? He already has another father figure and I'm beyond insulted to have to pay child support simply to subsidize the new father to take my place.

    You can't sign away your child. You can't force your ex's new spouse to adopt your child.

    Do you really want to keep your parental rights with your son or not? I'm not sure whether you are actually advocating for your son's best interest or just simply yours. Especially this: "I'm beyond insulted to have to pay child support simply to subsidize the new father to take my place."

    The new father takes your place ONLY if you allow that to happen. And paying child support is for the cost of raising a child, real parents actually realize this but instead too many "other" parents are unable to think in this way that the child they brought into the world has needs of their own. Rather they are unable to separate child support from their exes.

    Why did you not get your ex cited for contempt or file for primary custody months ago when she refused to follow the visitation order?

    No. If the stepfather wants to adopt then they can file a stepparent adoption and if you agree to it, then you will have your rights removed and the stepfather will become his father.

    If he doesn't want to adopt him then you remain his father.

    If you love your son. Please don't allow him, your ex and her husband to make a decision only you should make. It is normal for teenagers to not want to spend time with parents. This time next year. Your son may not want anything to do with his mom and step father.

    Teenagers should never be allowed to influence these types of decisions. If you love your son. You have to fight for him. Just remember the way a teenager feels today about things like this is temporary.

    Take your ex back to court on contempt.
