    Default Will a Bad Check Conviction Affect Naturalization

    Hello everybody I'm new to this forum. 20 years ago i wrote out 2 checks that bounced totaling $1,300 i plead guilty and paid all court costs and restitution and was sentenced to 1yr probation.9yrs ago i adjusted my status to a permanent resident applied for my Green Card and was approved now with the help of my attorney, i applied for my citizenship and got an interview 2 weeks ago i passed the civics and government test but the i/o did not give me the N652 he only told me he cannot make a decision at this time is this normal? and does bad checks count as CIMT in Pensylvania? Should i be concerned?PLEASE HELP

    Bad checks are CIMT everywhere. Had you disclosed the charge on your N400?

    Yes i gave USCIS a copy of the disposition in 2007 before i adjusted my status and also when i filed the N400.After doing some digging, bad checks is not CIMT everywhere [USCIS interim decision #3167 volume 20 page 440].

    I wouldn't bank too much on that. The law was revised TWICE after than decision was made. It appears pretty clear to me, the law says you wrote checks knowing they wouldn't be honored. Hard to argue intent to defraud there.

    Anyhow, that's not much here or there. Given a good explanation and passage of time without further action, while you may get raked over the coals about this, I suspect it won't bar the naturalization from proceeding. If you get a request for more information, you may wish to have an attorney look over your submissions.

    Thanks for your response. Do you think if that was a problem my green card will be issued? also about the N652 is it normal for the officer not to issue n652?
