    Default Do You Need A Lawyer For Child Support Modifications

    My husband is going into court to try to lower his child support payments because we have a new child of our own. He got a letter in the mail asking him to appear at the child support office and answer interrogatories to help his case proceed. The paper says that the opposing attorney wants him to answer these questions. We never hired an attorney. What is this for? Do we need an attorney?

    That is not a reason to lower child support.

    To answer interrogatories to help his case proceed. There will be thousands (well...not really but a lot) of questions he will have to answer.



    Do we need an attorney?

    I personally would get one. It's up to you.

    In some states, but not all, having another child to support is a basis for a modification of support. Child support laws are different in each state.

    Considering the child support was set before our child was born and it was set way to high the child support office pushed for the adjustment. When we cant afford to make rent and buy our child's formula and diapers my husband and I think it's a pretty good reason. And the state law says child support is set for the best interest of all the children involved not just the one.

    Support may have been set too high, but if it's within the guidelines, you could be in for a rough go of it.
    The courts usually wont take away from child A to support child B
    If you get around to it, post here what happened when it's all over.
    I'm curious to see if child support is lowered.

    In TN, parents can be given a credit for subsequent childrent however the credit may not be enough to warrant a decrease in support. I suggest that you run the numbers to see if it would even be worth trying to go to court over.

    Has there been a change in the income of either of the parties?

    when i had my support hearing in MAR 07 (I live in FL), i was told that having another child doesn't matter (new baby due 9/07). the only reason i was able to get a reduction in my child support amount is because my oldest did not qualify for child support. I had to get a second job in order to support my current family. Child support officers (in FL) are unsympathetic to most circumstances. Good luck, maybe you'll get lucky.

    That is in FL. The OP is in TN, where the guidelines do allow for a credit of other children to which the NCP pays support. As I stated earlier it may not be enough of a credit for an actual deduction though.

    It would be nice if people stopped having children they can't afford.

    We went into court and got it lowered $150. If people quit having children they could not afford then half of us probably would not be here today. Having a child right now was not high on my list but God had other plans for us and I plan to support him and raise him the best I can. And you know what I hope in four years God blesses us with another one. I have not met one person yet who has said children are affordable.
