    Default Police Response to a Noise Complaint

    My question involves criminal law for the state of: New Mexico

    Every year for Christmas, myself and my boyfriend decorate the whole house while wearing festive outfits/costumes and we play Christmas music while doing it. We have always played it loud and have never had any complaints. This year, we were playing "Jingle Bell Rock" while decorating, and I was wearing a sexy Elf costume and my boyfriend was wearing a sexy Santa costume. We were having some drinks and dancing while decorating when the doorbell rang which we barely heard over the music.

    My boyfriend answered and was stunned to see a police officer standing there. The officer made a gesture moving his index finger in a downward motion and mouthed "turn it down" my boyfriend called out to me to turn it down and i did and went to see what was going on. The police officer said there had been a noise complaint and that we had to turn the music down, and if they had to come back there would be repercussions.

    We told him we do this every year and had never had any problems and the officer said thats irrelevant and the music must be turned down. We offered him an extra Santa hat we had but he declined the offer and left. My boyfriend said to me that night in bed that he can't help but feel that some crime was committed.

    The fact that there were no complaints in previous years only means that you may have gotten away with violating the city or county noise regulations in the past. If the music was loud enough to violate the city or county noise regulations then the cop could have cited you for it. Be glad that all he had you do was turn it down.

    And one other thing: while putting up Christmas decorations before Thanksgiving isn’t a crime, it probably should be.
