My question involves a traffic ticket from the state of: Ohio
I was a passenger in a vehicle making a left turn. The light had turned red before the turn was made but since the car I was in was in the turning lane and in the middle of a busy intersection we went. A car from the other direction hit ours in the rear corner.
The driver of our car was cited for failure to yield, the driver of the other was not.
I and a witness that stated the other car went through a red had no statement taken at the time. I had to call IA to force them to get mine and the witness contact information and statements. The witness and I had previously exchanged numbers and admitted via text that she offered her statement and the officer told her twice to leave. IA then had the Sargent contact me to get information and then the officer finally called me the next day.
My questions are: Can the driver fight the citation since the officer had written it before getting statements? Also, how do I amend parts of the police report ( my name/info is wrong, the MPH posted is wrong, the driver address is wrong, the diagram doesn't follow what is written on the report to have happened, etc.). Currently since the driver of my vehicle is cited, the report says she is at fault. But the random witness that stopped admitted that the driver who hit us went through a red light and in fact, had sped up. No braking sounds were heard or on the ground at the scene.
I respect law enforcement and have had multiple of wonderful experiences. This is not an attempt to do anything other than get the facts correct on the record. I also had made the 911 call initially and felt incredibly dismayed that the officer never tried to talk to me until after IA and his Sgt had talked to me much later that evening.
