    Default Can You Apply for a F1 Visa During J1 Home Residency Requirement

    I am serving my 2 year HRR due to my J1 visa. I have completed one year and will be finishing the two years end of July 2018. I am planning for my masters and if I apply for my F1 visa say during June 2018, will I have issues with getting F1 accepted? Also, I will probably leave my home country only in August 2018 (I would have finished my 2 years by then). Would there be an issue for future h1B conversion?

    The J1 is not going to be an issue, but I'd avoid indicating the fact that you intend to exploit your non-resident visa for another purpose.

    You mean the F1 is not going to issue, right? Would there be a chance of rejection of F1 based on the incomplete HRR?

    As long as you either complete the HRR before your entry date or you get it waived (it's your home country that has to do that), there should be no impact on the F-1. Telling them you want to parlay your F-1 into subsequent visas in the US is the issue that you would have. It shows you may have immigrant intent on a non-immigrant visa.

    There is no need for any sort of waiver. A F1 visa is a non-immigrant visa, so you can obtain a F1 visa before you complete your HRR, and you can enter the U.S. from your home country under your F1 visa during that two year period. The time you spend in the U.S. as a student will not count toward the HRR.

    You will not be eligible for any immigrant visa or status in the U.S. until you either satisfy the HRR or obtain a waiver.
