    Default What is the Punishment for Selling Ecstasy

    My question involves criminal law for the state of: Los Angeles California

    I was at a rave event in San Bernardino California
    I got caught with 8 to 12 ecstasy pills. Well the person that I was selling to was and undercover cop. What will happen to me?
    I’ve seen that I may get 1-3 Years in prison and/or 10k fine. I got 2 dui in my record.
    I really do not want to go to jail. Can I ask for The fine and drug test?

    You can ASK for anything you want.

    Asking is not getting. Just because you ask, doesn't mean that's what you're going to get.

    Ecstasy is Schedule I drug, the possession or sale of which draws the most serious penalties for drug offenses under California and federal law. If charged only under state law you could be looking at up to three years in prison, not jail, and up to a $10,000 fine. What you will actually get if you are convicted depends on the details of your offense, your criminal history, and how the judges and prosecutors in your area tend to treat this kind of crime. Maybe you can get probation and/or a fine and avoid prison. If you can get that, be thankful because prisons are pretty unpleasant places. You’ll need to talk to a criminal defense attorney in the San Bernadino area to find out your options and what you might realistically expect to receive as a sentence in this case. While no doubt you’d really not like to go to jail or prison, you ought to have thought of that before getting involved in an illegal drug transaction. The old expression “don't do the crime if you can’t do the time” applies here.

    Fortunately for you, California has all but legalized even the hard drugs. Chances are you will get a plea offer to possession (a misdemeanor), or, at worst, a shot at a sales conviction that will result ian short county stay and probation.

    Your attorney will have some idea of the prospects of any deals in San Bernardino County. But, state prison time simply will not happen. County jail is a real possibility - almost certainly for a short period on a felony, and maybe for a misdemeanor deal. Expect fines, probation/PRCS, and some sort of drug treatment program as part of any deal.
