    Exclamation Will an Inactive Domestic Violence Case Affect a Green Card Application

    Case in: California.

    I was falsely arrested half year ago. (no other criminal record at all); They initially wanted to charge me as Domestic Violence, Felony. But maybe because I told them more factors after my arrest, and the victim may admitted she attacked me first.

    Police apartment did not file the charge and the case never went to the court. police apartment said "my case is in a dormant status, and will be dying there in police apartment "; the arrest has been reclassified as detention.

    So my question is : will this affect my green card application? I am doing the application right now. if yes, How much will this affect? and how should I do? Thank you very much for any suggestion and comments in advance! Any comments/suggestions/discussion counts! Jack

    This will not affect your green card.
    It will have to be disclosed and dealt with if and when you apply for naturalization, but even then it's not going to amount to as much as your apparent psychiatric problems.

    Thanks to the helpful information and suggestion from nice people like you, I am very confident now and will move forward with my new life.
    I am not going to disturb you again about this case with the same questions.

    Any time you report an incident that involves law enforcement, you should anticipate that the USCIS will ask questions about it. An incident that results in a police or prosecution determination that there is not probable cause that a crime occurred is not likely to be a major point of interest during an interview, but you should expect it to come up -- and you should recognize that your answers to the questions could turn a minor distraction into something of greater concern.

    Talk to your lawyer about the incident and see if your lawyer suggests consulting or working with an immigration lawyer.
