    Default Divorce From a Marriage Between First Cousins

    My question involves a marriage in the state of: Illinois
    I got married 17 years ago in a differente country and seperated 3 years ago and file for a divorce two years ago. We are first cousin and leaving in Iliinois for 13 years. I know our marriege is not leagal in Illinois but I was wondering what will happen to our assets . My ex has retirment plan and I don’t have anything. We have a 14 years child also.

    Just because Illinois would not issue a marriage license for 1st cousins to marry does not mean that Illinois will not recognize a marriage that was legally done in another country, nor does it mean that you would not receive your fair share of the marital assets. You really need to get a divorce attorney to represent you for this divorce.

    Thank you for your response, I have an atterney working on my case, but he is not familiar with this kind of situation. Is there any resurce or some helpful guide that can help me on this situation, I am worry that I maybe loose all the assets and retirement plan that my ex has and we made it during our 13 years of marriage and all are under his name.

    As far as divorcing goes, there's nothing special about your situation. You are married. To end your marriage you need to get a divorce -- the same kind of divorce that any other married couple would pursue.
