    Default Injury During an Non-Work Activity Required by an Employer

    Hi!

    I had an accident while participating in an exercise program that my boss paid for and made me go to. I broke my leg in 3 places. Then, of course, I wasn't working for some time... Can I sue him?

    Well, you didn’t provide your state as you were asked.

    Additionally; why do you believe your employer is liable behind what workers comp covers? There is often provisions to sue an employer under some circumstances but with the lack of information posted, I don’t see any of those circumstances present.

    The details of why you are going to these exercises, how you got injured, and in what state you are employed and, if different, the state where the injury occurred matter. That said, generally the way it works is that if these exercises were considered to be on the job then the injury is covered by worker’s compensation. Worker’s compensation pays regardless of fault and where worker’s comp applies it is usually your sole remedy with respect to the employer. If this was not on the job then in order to successfully sue your employer for the injury you must prove that the employer was negligent and that the employer’s negligence caused the injury. In other words, you have to show that the employer was at fault for causing the injury. The employer paid for you to go, which makes it sound like this was some program that was run by someone other than your employer. If that’s the case, how is it that your employer is at fault for the injury?
