    Default How Long Does it Take for FBI NICS Records to Update After a Conviction is Sealed

    My question involves criminal records for the state of: Michigan

    Hi Everyone,

    I've just had my Juvenile with adjudicated Assualt with a deadly weapon charge set aside in the state of Michigan. I'm looking to have my gun rights restored federally and have the NICS check updated with my sealed expunged record. I know for a fact the Feds will respect set aside records for the state of michigan and will restore all my rights. This charge was when I was 14 and I'm 30 now.

    I'm looking to understand how long it will take for the state of Michigan to update the FBI and the NICS check so I can get a CPL and pass a background check.

    Has anyone had experience with this in the state of Michigan? Also just for anyone who will ask, my copy of the expungement does not say I cannot have firearms or ammunition in my possetion.

    Any advice or expert experience would be great! My attorney tells me he sent the document to the MSP Friday so it will take about a week to update their records.

    If a person's juvenile adjudication is set aside, that has the effect of restoring the person's civil rights under state law. Assuming no disqualifying adult conviction (e.g., a domestic violence misdemeanor) that should be sufficient to remove federal impediments to firearms ownership.

    Unfortunately, there's no way to guess how long it might take for the NICS to update. Some people find no update even five, six months after-the-fact.

    Crap, I was thinking it.might take awhile but not that long. Does anyone know if I contact michigan State police and have them forward the information to the FBI or NICS and they would update it that way?

    I was going to start the NICS appeal request but I hear that it's a 2 year wait....YIKES!

    I'm no expert here but just telling you my experience because I'm going thru this right now. My conviction was several decades ago, was automatically reduced by function of law to a misdemeanor afterwards, comes up all these years later with no arrests in between as a felony now. Due to old case, no court records avail to prove otherwise so had to go thru court process to get reduced under a 17(b) as if it had been a felony all along over these years which was impossible. Been over 8 months since the court issued the reduction order and just now got an updated copy from state records ( 1 week ago). Between all this and nics appeal currently going thru will be 4 years after the new year and still no answer. Be patient I guess - they don't give you any other choice nor information it seems
