I am asking this for my son. He worked for a company that was small, 2-3 people, father & son company. The man he worked for let him use a Company truck, gave him the keys and told him he could use it for work and on this particular weekend.
My son went to Big Pine Key (Key West) for the weekend, he called his employer and asked to take a couple of vacation days that were coming to him along with the weekend so he would not have to rush home. His boss told him NO, that if he did not return the truck within a certain time he would report it stolen (this man is the same age as my son and they were friends, and the boss is a control freak).
The boss reported it stolen over a year ago and my son quit working for this man, when the police came to pick up the truck, my son handed the officer the keys and asked if there was a warrant for his arrest. The officer said No, he just wants the truck.
10-12 months go by, my son received a phone call from this man, begging him to come back to work that he would drop all charges and he needed him to keep his business afloat. My son came back to work for this man in March 2005 once again driving this so called stolen truck for the company. On July 20, 2005, he had enough of his game playing boss and took the truck to his house and left it in his driveway with keys and any company belongings in the truck and quit.
This man proceeded to call my son and threaten him that if he did not return to work for him that he would call and have him arrested for this warrant over a year ago that he did not press charges back then. In the meantime, I had called the police to make a report of his phone calls and threats. They were here at the residence when this idiot called and reinstated the warrant for his arrest. My son went to jail and was bonded out for $200.00. Now he has a arraignment set for August 4th.
This man (his X-boss) made threats to kill my son and us telling him
that he would make life miserable for him if he did not return to work. Only because my son is the one who keeps his business going.
Will he be prosecuted (the boss) for false reports to the State Attorney and have to reimburse the bail money my son put out for his foolishness?
