My question involves child name change in wv. I had lived in wv for almost 4 years. I have a 10 year old who currently has his father's name and he wants mine. His father name is not on the birth certificate, never paid child support, I've never even filed for any type of support from him. He lives in another state and has never lived in wv. He has only seen my child when my child was 1 and that was it. There has been no contact no anything since that day. We were never married either. Do I still have to locate him for me to change my child last name? The last time we even spoke was when my child was 1 and he filed for a DNA test, which he never even showed up for. The judge just dismissed the case since he never showed. What is the best route for me to go about changing my child's last name?
Are you saying that you did not put him down on the birth certificate as the father, but you did give the child his last name? Did anything else happen that would have determined his legal paternity? Was he ever ordered to pay child support?...therefore becoming the legal father by default?

If the child has no legal father you may be able to do the name change without any input from the biological father. See a local attorney for more information.
