    Default Should CPS Be Contacted if School Bus Attendant is Using Drugs

    My question involves child abuse or neglect in the State of: California

    If a public school bus attendant, who is responsible for securing disabled children and wheelchairs into a school bus for transport to and from school, is regularly using Cocaine and Marijuana before, during, and after work, are they guilty of child endangerment or neglect?

    Who are you to them that you are with them before, during and after work ? You would have to be with them in order to witness them using drugs. If you have not witnessed it you do not know what they are doing.

    Personally, I find it extremely difficult to believe anyone is using these drugs this often and doing this job with anyone they work with being aware of it.

    How do you KNOW this person is using "cocaine and marijuana before, during, and after work"? If you have knowledge of this, have you contacted the police? Spoken to the school administration? Done anything at all?

    When you say "bus attendant" is this person DRIVING a bus? Or, merely riding in a seat and strapping kids in? Note that drug use is not a disqualifying offense for most employment in the education system, so unless the employee is high at the time of police or administration contact, there may be little to nothing that can be done about their off hours use. Merely using those drugs is not sufficient (by itself) to constitute child endangerment.
