    Default Can You Get Unemployment Benefits After Relocation with a Domestic Partner

    My question involves labor and employment law for the state of: Kentucky relocating to Indiana

    Could I apply for unemployment? My domestic partner was offered a job in IN and we are having to relocate our family to IN from KY. We have two boys together and I currently work full time. However I was wondering if I could apply for unemployment benefits due to the circumstances and which state do I do it with? Or does domestic partnership counts in this case?

    A quick googling indicates that KY allows benefits for a "trailing spouse" only for military transfers but IN allows it for all job transfers, subject (of course) to any eligibility rules.

    You may have to wait until you get to IN to file.

    I suggest you get on the IN UI website and do your homework.

    This will make zero difference. The wages were earned in KY, the claim will be in KY, and will be subject to KY's rules. Applying in IN will do nothing but result in an invalid claim because of no earnings, or forwarded to KY for processing under KY's rules.

    My concern is less what state to file in, as whether following a domestic partner (as opposed to a spouse) is going to qualify at all. California includes DP's in their definition of spouses, but so far I can find no evidence that either Indiana or Kentucky does.

    IN doesn't have "domestic partners" so no, they do not get the benefit.

    I have to agree the domestic partner vs spouse might be the larger issue. I am not seeing where DPs get the benefit, especially now since SSmarriage is legal in all 50 states.
