    Default Will Going to Drug Treatment Stop Probation Violation Proceedings

    My question involves criminal law for the state of: georgia

    I was recently sentenced to probation in cobb county for drug possession that happened over a year ago. I was sent to take a drug test the day after my probation intake and before taking it I immediately called my new officer and told him I wasn't sure what the results would be but that I was going into treatment. He said that's okay as long as I go to treatment and send him the paper work within a week. So I did. While in treatment my landlord evicted us. The place I was receiving treatment usually doesn't let you leave in less than 5 to 7 days but they let me leave on day 3, after speaking with my landlord to confirm the situation, to handle the situation. I thought I would be fine but I was wrong. I got sick and did drugs.

    After being evicted, I moved to another county therefore I had to transfer my probation. I was told to report to my new office within 5 business days. I went on the 5th day when they were about to close so my new officer told me to come back the following Monday and take a test. Before Monday came, my previous officer from the county I was living in before called me and said he had to re submit all my transfer papers and start the process over. So I realized I probably have 5 more business days to report. But I did call my new office the day I was told to come in, and someone at the front desk said my transfer is still pending so call tomorrow. I called the following afternoon and he said I could come the next day. The next day he said she wasn't in the office so to come the next day. That was Friday. Now it's the weekend and I haven't gone yet but tomorrow would make the 5th business day, so I was going to go then.

    My question is... Would I get in trouble if I went into drug treatment today? I have been waiting on a bed to open up and it has. But I'm afraid to go without seeing my new officer. Thanks for any help.

    Given your inability to abide by the terms of your probation, including by abstaining from illegal drugs or appearing for meetings as ordered, there's not much more that we can do than suggest that you speak to your criminal defense lawyer.

    What do you mean you got sick and did drugs?

    You can still be written up for a violation even if you're in treatment - yes. You need a lawyer. It's up to you whether you go to treatment or not or call your new PO or not.
