    Default Arrest Record After Dismissal of Charges

    I was arrested in Washington state. The case was dismissed after a pretrail agreement. I checked the washington state patrol website and there was no arrest that showed on my record. I also did a background check on a http://www.intelius.com and nothing is showing up. Do you know what is going on or do you have any other suggestions for me to find out whether there is or not any record on me. Please advice.

    You have indicated that you were arrested. It doesn't matter what is in private databases, as they're not official. Perhaps you should with the arresting police agency on the off chance that they didn't classify what they did with you as an arrest.

    What is your end goal here? To tell the USCIS that you were never arrested? Check the documentation you would have to sign, as they may be asking more broadly about your encounters with the police. If so, that moots the issue of arrest as you would have to report it anyway.

    I was just asking a question-why would not it show on the record, that is it?

    when they ask me:

    Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action? Have you ever unlawfully distributed or sold a controlled substance(drug), or been a prostitute or procurer for prostitutes?

    I should probably say yes and give the explanation, is that the case?

    I am planning to seal or expunge my arrest. Do I still have to say yes even after the expungment?

    I don't know about where you are but in Texas you are not obligated to disclose expunged records.

    Keep in mind though that some employers will be able to unearth these records so depending on who is hiring you the truth may be important.

    Jobs involving any kind of security clearance as well as law enforcement jobs are off limits. I think if you work for the judicial branch of the govornment you may have problems as well.

    Some background checks only list convictions and others will also include cases that were filed. If you get one of those finger print background checks everthing will be unearthed with the exception of expunged records so it just depends on the background check.
