    Default What to Do if Somebody Resigns You From Your Job in Your Name

    My question involves labor and employment law for the state of: Georgia
    Hi, I went to work today and was suddendly denied access to log in. A manager approached me and said "yeah, I was actually going to talk to you about that... it shows up here that you resigned." I was told i had called and resigned. The thing is I never called and resigned. I actually never called at all. They made me leave the building and said I had to speak with Human Resources the next day (since its closed). Is there any legal action I can take? This place is super secure about picking up checks and you can't even walk in the building with the same person using your device thing (magnet). I just dont see how they were so quick to take someones word about resigning. Its just stupid.

    Apply for unemployment and pray that your employer can't prove that YOU were the one that quit.

    No, there is no legal action you can take (other than as chyvan has described). Not based on what you have posted. Certainly not before you talk to HR.

    Are you suggesting that when someone quits, they shouldn't believe the person? How often do you think it happens that someone quits for someone else? Why do you think they shouldn't take someone at their word?

    Contact HR on Monday and explain your situation. See what they say. Then, Google at-will employment.

    The likelihood is that IF you have any cause of action against anyone, it's the person who allegedly called in as you, not your employer.

    If additional facts emerge that you think might change the answer, post back.
