My question involves landlord-tenant law in the State of: California
I just had a roommate move out after 7 years and I am taking over the full lease of our apartment. There is a burn mark on the floor of his bedroom and when I told him he would be responsible for that, and that I would deduct it from his portion of the security deposit (I am having to pay him since I am taking over the whole apartment), he argued that any deductions would have to be split evenly. I think this is just him being petty, but want to know if he has any right to demand this (side note: his bedroom is always locked and in the 7 years we have lived together I have spent a total of maybe 3 minutes in there). He has also threatened to end the contract with our landlord and get the deposit back directly, which he claims would then force me to sign a new agreement with my landlord. I am in San Francisco, and in a rent-controlled apartment, so that would mean an extra $1000-$1500 a month.
To sum up: 1) Does he have any right to one-sidedly end a lease with our landlord? 2) Can I make him pay for the whole amount charged to fix the burn mark?
