    Default Can a Probation Officer Search the Room of Another Resident

    My brothers probation officer searched my room not my parole officer. Is this legal? Im in georgia.

    It's quite likely even if you were not on parole, they could have searched your room. And since you are both under supervision, yes any DCS agent can check either of you.

    Was the search predicated merely upon your being on parole, or was there additional cause for your search -- such as cause to believe that contraband might be found in your room, or that your brother was also using that room of the house?

    No something was found in his room then they came and searched mine. They had a dtf agent along as well, but their never was anything said as to the reason for coming in the first place. His probation officer had just visited a couple of days ago.

    If the probation officer was present with a drug task force officer, then odds are this falls under a term of your parole through which you agreed to let your room be searched by law enforcement officers at any time and for any reason.

    If they did not find contraband, you should consider whether you want to continue to share a home with your brother. If they did, and you may face (or are facing) new charges or parole violation proceedings, then you need to get in touch with your criminal defense lawyer.

    They found a schedule 2 controlled subtance in my room but did not arrest me. They said a warrant would be issued the next day and they never returned. Why is that?

    They may have obtained a warrant. Getting the warrant does not mean that they come out immediately to make an arrest. As drugs were found in your room, I think it would be a good idea for you to get a lawyer now to be prepared for the possibility that your probation might be revoked and/or that you will be charged with new crimes.
