    Default Spotted by a Store Employee After Shoplifting

    My question involves criminal law for the state of: Texas

    Today I was shoplifting in a boutique. After I left, I went out to my car, put the lifted items in my car, got out, and walked to a store around the corner. When I left, I walked out to my car. As I was starting it up and getting ready to go, the woman who was working that day walked out to my car (my window was down) and said “what’s your name”. I said “Ma’am?” And she saw the stolen items in my passenger seat and said “you wanna give that back to me?” And I said “What are you talking about”. As she was doing this she was shaking my car door handle trying to get in. And she went to look at my front license plate. As she was trying to do that I put my car into drive to get out of my parallel parking spot. She held her phone up to her ear like she was trying to call the police. I drove away so quickly that I hit my headlight on the car in front of me and busted the light. In about 3 seconds I was around the corner out of her view. The store had cameras however, I was sure to conceal the merchendise out of the cameras view. Do you think I’ll be ok?

    Nope. Not only have you stolen property, you’ve committed a hit and run accident.

    What amount of value in merchandise could you have possibly stolen that it would be worth going to jail for?

    I am in awe of the gall of this poster.

    She admittedly shoplifts. She commits a hit and run. She chooses the screen name, Not A Criminal, even though she's just confessed to two crimes.

    And then she asks a legal board to assure her that she's not going to face any consequences? That she won't need to take any responsibility for her actions?

    Damn, girl. There's nothing okay about your situation.

    You should hope that they prosecute you under a shoplifting/theft charge and not robbery or even armed robbery in addition to the leaving the scene of an accident charge.

    The robbery charge is possible because Texas robbery laws define robbery as committing an intentional theft and then "recklessly causing physical endangerment" or threatening bodily harm. You did "recklessly" leave the parking spot and left a smashed vehicle there as evidence, as well as "physical endangerment" because most likely the employee had to jump out of your way as you made your escape. You could even face armed robbery as your vehicle would be categorized as the "weapon".

    Texas law states, if the defendant used a "weapon" (your vehicle) as either a threat or to "impose real physical injury", this could elevate the robbery charge to armed robbery. Your vehicle could be the weapon.
