    Default Payment of Court-Ordered Shared Living Expenses After Divorce

    My question involves marriage law for the State of: Indiana
    Me and my Ex-husband are sharing living expenses in a home we both own. On our divorce agreement, it outlined that my Ex is supposed to give me a stated weekly amount as his share of our shared expenses. He has missed one week without any explanation. Before our divorce, he is an alcoholic who has a history of blowing his money at bars and stays out days at a time. We have been divorced for six months and he has given me his share of the money for expenses, but I can see this changing as time goes by. Since I am divorced and have no legal responsibility for him, can I take him to court and file a breach of the agreement and have him removed from the home if he continues to not pay his part? Thanks.

    When you say that he missed a week, do you mean that he missed the most recent week, or do you mean that he missed a week and then resumed payment, without missing any subsequent weeks? What did he say when you asked him about the missing payment?

    You can take him to court to enforce the order. If he comes up with the money before the hearing, the issue becomes moot.

    As for trying to get him out of the house, the judge isn't going to kick him out over a missed or late payment for a single week. If this continues to be a problem, the court's inclination will likely be that the home should be sold.

    I want to keep the house and have no problem with him living there as long as he carries his own weight. I have taken care of him for years because I was still married to him. We have no equity built up in the house and it's not even close to being paid for. He has lost jobs on and off during our marriage and during the down time I had to make sure the mortgage was paid and the other expenses too, on my own. If I wasn't there to cover for him, I seriously believe the house would go into foreclosure. I have two pittbull dogs and two sons who live with us, and I don't want to give up the house. This is the first weekly payment he has missed, but I am afraid this is the beginning of his pattern of ignoring the divorce agreement.
