    Default Why Would a State Seek Extradition on a Misdemeanor Charge

    My question involves criminal law for the state of: Georgia. My son received a felony charge in Florida and received 5 yrs probation. He also received a misdemeanor assault charge in Georgia after his felony charge in FL. He served 5 months in Georgia, then FL extradited him and he served another 5 1/2 months. He was then released to complete a 6 month program. Which he did satisfactory. His probation then took effect after the program was completed back in GA.

    He was charged a VOP from FL on not getting permission to move, but we just proved to the court that he did get that permission-so the FL court was reinstating his probation and releasing him to return to GA. Of course they ran NCIS before releasing and saw that GA had issued a warrant for his arrest for VOP now. He had been reporting to ONE PO for both charges. Since he had a felony from FL first-he was on felony PO, even though there was no felony in GA. Now that FL has found to reinstate, why does GA want to extradite him on a misdemeanor charge? when speaking to the people in GA at the jail, they keep saying because he was on felony probation! But only because of FL not GA....I don't understand. Is there anything that I can do to change this warrant?

    The fact that Georgia has issued a warrant does not necessarily mean that they intend to extradite him; but if it's an interstate warrant or they are already in the process of seeking extradition, that is their right. States do not ordinarily extradite for misdemeanors, as it is a costly process.

    If extradition is in process, your son should consult a criminal defense lawyer. If it is not, it may be possible for a lawyer in the Georgia jurisdiction where the probation violation warrant is pending to work something out although, even if he can work out a favorable disposition, it is likely that your son will have to appear in court.

    You can't do anything. Your son is a convicted felon and needs to get himself an attorney.
