    Default What to Do if a Case Was Supposedly Adjourned but is Still On the Docket

    My question involves collection proceedings in the State of: Michigan
    The lawyer that is taking me to court tomorrow, it's a pretrial. He left a message stating "Since you are going to file for bankruptcy, we are just going to adjourn for 30 days and look at it then" I called him back, left a message telling him that, that was fine. Well as of 225pm the case still shows open. Not sure what I should do.

    Since it's a pretrial, what should I expect? Should I bring up the fact that to the judge that i Was being deceived? I do still have the voice mail

    If you go to court, odds are you are going to find that the case was adjourned and that you wasted the trip. It could also be that the lawyer will be in court anyway, and intends to (or, given the timing, has to) request the adjournment in person -- it's late to be asking for an adjournment, and you have not signed any stipulation to adjourn.

    Check the court's website if they have an online docket, or call the clerk before close of business to see if the adjournment went through. Keep in mind that online dockets are often not updated in real time.

    If the case is not adjourned by the close of business, and you have time before you have to leave for your court hearing, check again.

    Yeah, that is kinda what I was thinking, now being a pretrial and lets just say I took his word for it and didn't show, could I get a default judgement?

    Possibly. Its never wise to not show up for court unless its certain that court is cancelled or adjourned.
