My question involves a traffic ticket from the state of: New Jersey.
Hello guys,
Been reading the post on and off in this forum which have tons of valuable info here.
So last Sunday, going home with my girls after watching the boring IT movie, i noticed a guy tailing me, but did not pay much attention, i kept checking my speed and was not worried about anything, as soon as I was about to pull into my driveway the lights went on and got pulled over.. I was really surprised and asked why i was pulled over, apparently I swayed over the yellow line, and did 43 in 30 mph zone ( which is only 200 yards) and jumps to 35 mph, and he wanted to make sure i WAS OK, I haven't had a drink in over 6 months so i didn't have to worry about it, and i know i almost never sway, so i told him this is not possible, his argument was that he has all that recorded on camera, his words were and I quote, let me check your records and you will be out of here in no time. Well he comes back with 3 summons:
1.39:4-98 Speeding 43 in 30 mph zone
2.39:4-82 Failure to keep right
3.39:4-144 Disregard Stop sign regulation or yield sign.
My last speeding ticket was over 6 years and no other violation since. I was upset, and got in some exchange of word especially after he said oh btw you did not fully stop at the stop sign.
I plead no guilty obviously and planning to fight all the charges, and did call the police to confirm that there are video recording on the police cars and they confirmed, but i need to file a discovery.
I found some discoveries which seemed pretty good, however I'm looking for some additional info since in my opinion this is not a typical speeding with the use of radar, I would assume either he looked at his own speed, or the camera has some type of speed indication.
So my additional info I would like from the discovery besides the recordings:
1.What device was used to measure my speed.
2. Information about the police officer his shift working hours and so on, since it was roughly 10PM maybe he worked long hours that day/week if fatigue might played a role ?
To my understanding the cars don't always have accurate speed measurements so i would say its not an accurate device to verify that i was speeding, so if the officer did base it of that I'm hoping it could be some grounds for some type of scrutiny.
Are these reasonable request to ask in discovery ? anything else i could/should add ?
If someone has a good discovery document, please point me to in..
Thank you for reading.
