    Default Good Enough Reasons to Get Emancipated

    Hi everybody. Well I guess a lot of people on this message board would say their life is shitty and they want out of their family. I am one of those many people. My mom is uprooting me from my home in Priest River, ID to make me move to Dallesport, Oregon to live with her, my older sis and my mother's girlfriend. Yes, my mom is a stupid dike. Please don't get me wrong, I have no problems with Lesbians or Gay people, but I do have a problem with my mom being like that. This post isn't about that however. I am turning 15, August 4, and realize to get emancipated I need to be 16. I was just wondering if anyone knows how hard it is to get emancipated and how I go about doing it. I want to gather all the information I need on the subject over my gruesome year of being 15 until I turn the age to do it!! I don't have any problems such as my mom beating me or anything like that. I do however have verbal abuse I could use against her and who knows what to come. If anyone has any help they could offer me, that would be great! Thank you so much.

    Default Oregon Emancipation Law

    As you will be living in Oregon, you need to concern yourself with Oregon's emancipation law. If you petition for emancipation in Oregon, the judge who hears your petition will decide if it is in your best interest to be emancipated by considering:

    * Whether you have been living away from your parents; and

    * Whether you can support and care for yourself without parental assistance and supervision.

    If the court grants your petition for emancipation, under Oregon law your parents will have no further duty to support you, you will be treated as an adult under the state's criminal laws, and you will have the right to enter into contracts, sue, and be sued.

    I court is not going to emancipated you.Only if they see its in your best interests.I tryed to get emancipated but they said it wasn't in my best interests.But who are they to tell people's best interests.

    I'm a lesbian, & I cant "BE" w/ my girlfriend because of parental issues.
    I really think they've taken it way too far. I'm NOT dropping out of school, on drugs, having sex, smoking or drinking. Could that be a good reason to file a petition for emancipation?

    Emancipation gives you certain rights of an adult. You must be at least 16 years old, able to support yourself, live on your own, and manage your own affairs. You need to file a Petition for Emancipation with the Juvenile Court in the county where you live and give a copy of it to your parents. The court will set a hearing to make the decision. The judge will decide if it is in your best interest to be emancipated by considering whether you have been living away from your parents and can support and care for yourself without parental assistance and supervision. If the court allows you to be emancipated, your parents will have no duty to support you, you will be treated as an adult under criminal laws, and you will have the right to contract, sue, and be sued. Emancipation does not give you the right to drink alcohol, vote, or marry.

    Correct. And in relation to the more recent inquiry, not being permitted to date (whatever the circumstances) is also not a basis for emancipation. A key element under Oregon law appears to be the ability to support and care for yourself without parental assistance and supervision.

    In terms of initiating emancipation proceedings in Oregon,

    You must be at least 16 years old. You should call the Juvenile Court in your county, and ask to speak to the intake counselor in charge of emancipation. Request an application form from the intake counselor.

    I want to go about and get Emancipated. I Been thinking about it for about a year now. I am 16 and want to get emancipated when i turn 17. I have been looking at houseing and i fround a couple of places I can affored and rent. I also can affored my food and living expensives. The only problem is my parent dont want me to move out. They dont abuse me in any way so will the court still let me. I live in Idaho and i heard that they dont have a Emancipation program. If there is can you please send me the Fileing code and were I can find the paper i have to fill out. I really think this will be good for me. Also how can i go about getting a free lawyer?

    Starting your own thread will get you further with your ansers. .

    Couple of other pointers is you must be doing well in school and have a long standing job that will provide enough income among all other issues.

    Lawyers don't typically work for free.

    Why do you need emancipation? Emancipation is granted upon NEED, not want.

    Why do you NEED emancipation to survive?
