    Default Immigrant Spouse Abandoned Fifteen Days Before the Immigration Interview

    Kind people of this forum,

    I'll keep this straight to the point and focus on the facts because I'm shaking as I'm typing this unable to calm down.

    - Wife and I have been in a relationship for 5 years.
    - Married two years and 1 month ago
    - We have had my change of status petition in the works for years now and we finally received our notice to appear for the interview about two weeks ago.
    - We live together, sleep together, pay bills together, plenty of evidence of bona fides marriage. Except...
    - Out of nowhere wife just informed me that she will not be going to the interview with me, period. She's moving out soon and she will not change her mind no matter how desperately I plead and beg.

    I don't understand, merely days ago we were watching shows and laughing and everything was as normal. NOW THIS! I don't know what to think, I'm devastated and I'm completely shocked by what's happening. Maybe she has lover, she has been acting differently for a while but I did not challenge her on it for the fear of something like this happening!

    From the limited research I've done, I'm completely screwed. I thought maybe if we get a divorce in time I could go through with the interview anyway since I have plenty of evidence that we were in a long term serious relationship. HOWEVER, I DO NOT have my conditional green card. I married her while already in the US and I am still an international student on an F-1 status that expires in May.

    Please! I'm fearing for my future and desperately looking for a ray of hope. Any and all good advice will be priceless now.

    And YES, I'm definitely hiring a lawyer, I'm just looking for as much info as I can gather before I act.

    My undying gratitude to anyone who will advise to me in this dire time.

    P.S. We live in Pennsylvania, if that makes any difference.

    With her abandoning the marriage before you have your conditional Green Card, if you want to obtain permanent residency as a result of the marriage you will need to demonstrate that you entered the marriage in good faith. That's not particularly unusual -- but it would make sense to at least consult an immigration lawyer before the hearing to discuss the details of your case, and perhaps to retain the lawyer to help you form a strategy or to represent you.

    The tone of your post makes it seem you are more concerned about your green card than your marriage. Perhaps your wife has reason to suspect that you will be leaving her as soon as you have the card in hand; marriage for a green card is not unusual. The long term financial obligations of a sponsor is a significant consideration. In addition, the ability of a spouse of a US citizen to naturalize in 3 years and then be able to sponsor numerous family members - including parents for almost immediate immigration - could make the US citizen spouse wonder if s/he si being used especially if the immigrant spouse is determined to bring others to the US. The US citizen spouse can fear that the long term financial obligations of the marriage are troubling.

    If your tie to the US is your wife and you are no longer together, the green card is irrelevant.

    Since you have a student visa, you may avail yourself of OPT and seek an H-1B employer to sponsor you for a green card so the denial of a spousal green card is not the end of the world. It is just a longer path to permanent residency.

    You definitely need an attorney.
