    Default How Long Does it Take for DCS to Act on a Neglect Complaint

    My question involves child abuse or neglect in the State of: Indiana

    Recently my sons mother (custodial parent) has been reported to DCS for neglect. She has refused to speak with DCS and has not allowed DCS to speak to my son either. She has also involved her attorney and cancelled meetings they have had to sit down together. It is also past the 30 day mark of DCS having to have their report made. My question is.. at what point does someone step in and do something? She can't continue to avoid DCS and they say they are limited on what they can do/say no that attorneys are involved.

    It depends on the facts, none of which are known to us. It could be that DCS will find the accusations to be unsubstantiated, and take no action.

    She doesn't have to talk to DCS and she doesn't have to let your child talk to them either unless there is a court order for it. She has every right to have her attorney involved.

    She can avoid DCS as long as there is no court order that states she has to talk to them or turn the child over or anything.

    If CPS had reasons to believe the child was in danger they would have gotten a court order. If the child attends school or day care, CPS could have talked to the child there. It sounds like CPS may have not believed the situation was,as serious as you do

    And, as a note, the report you mention is a 30 day assessment of the status, NOT a final report and disposition. DCS can keep the matter open and file another assessment every 30 days ad infinitum, it seems. It's not as if she can dodge DCS and they will just let it go. If they think there is something to the allegations, and they have sufficient cause to convince a judge, they could get a court order allowing them to speak to the child or take her into protective custody. Otherwise, even if it remains open, there may be little more to do with it.
