    Default How Long Does it Take to Receive Child Support After an Income-Withholding Order

    My question involves a child support case from the State of Indiana.

    After a lengthy and frustrating post-decree custody battle, my ex and I finally settled and filed a new agreement on 8/8/17. A part of that was modification of child support (previously, neither party paid support because we shared 50-50 joint physical custody and had similar incomes) and an Income Withholding Order was filed on 8/9/17. My ex was instructed to make payments directly to the INSCCU until the IWO went into effect. I am not at all surprised that he has not made any payments on his own, but since it's been about a month since the IWO was filed I'm beginning to wonder when I will start seeing payments.

    His first paycheck since the IWO was filed was on 8/24, and while we are both in Indiana his employer is based in California. I have checked the payment history on IN's child support bureau website but as I am the CP, I can only see disbursements that have been sent to me (and there have not yet been any) rather than payments made to our case.

    Any guidance on how long this process takes would be fantastic--my attorney indicated that it would take "a couple of weeks" for my ex's employer to process the IWO, but was not any more specific than that.

    It depends. I'm in a different state but the few times my ex has had a job in the last two years it has taken two weeks before child support started to get taken out of his paychecks. Last year in November is the last time he had a job (for a whopping three weeks). He started beginning of November. I think around Thanksgiving I started to get child support.

    They won't take out support until the employer notifies them that he is an employee there. If you don't get anything by the end of the month I would call someone. It shouldn't take more than two weeks.

    It can take a few weeks after the employer receives the IWO. It can even take as much as six weeks.

    Thanks--I knew it could take a little bit, and I have looked into the California time limits for enacting the IWO/sending payments to Indiana for his employer and that overall timeframe isn't over until the end of this week (10 business days to enact the IWO, then 7 business days to send the payment to INSCCU, and then 2-3 business days for them to send it to me). I think I was kind of hoping that it would not stretch to the maximum amount of time authorized, especially since while we were working through the custody issues with our attorneys, he's accumulated over $5,000 in arrears since he has refused to pay anything directly to me. It's not quite as critical now that the school year has begun and I'm not also shelling out $1,000 monthly for summer child care, but I'm definitely ready for him to offer some kind of engagement and support for his children under our new circumstances.
