    Default Vehicle Towed After Following Apartment Manager's Directions

    My question involves landlord-tenant law in the State of: Florida

    Greetings,

    I am in a bit of a pickle with a vehicle that I own. The information is listed below:

    On July 17th I contacted (property manager) via e-mail in regard to obtaining a parking decal for my 2002 Jeep Wrangler to park in the overflow parking spaces by the pool. There was no reply to my e-mail. On July 21st I physically made an appearance at the Managment office. I spoke with two of the front desk secretaries about my desire to get a parking decal. The secretary asked me for a vehicle registration in order to document the vehicle information. I stated that the vehicle is not registered and does not have a tag, but that I could provide her with the certificate of title. She then contacted the property manager who confirmed that the only thing I needed to have on my vehicle was the decal. She also stated that per the property manager, I could park in spot 8 or 9 by the pool. I proceeded to email my certificate of title to the secretary for documentation purposes. Roughly one week after, I noticed a pink slip on the Jeep. It stated “Please call me, I need to register this vehicle with an address. Property Manager”. I contacted the property manager that day providing him with my address and asking him to return my phone call to confirm he received it. I never received a phone call back.

    On August 22nd I returned home from a vacation and drove to check on my Jeep. When I arrived at the parking space, the Jeep was gone. I contacted the tow company and they confirmed that they had towed the jeep at the request of the property management. I then sent the property manager an e-mail asking him to contact me, that the matter was urgent. I never received a phone call or e-mail back. I again, drove to the management office. I spoke with the same secretary who confirmed everything that we spoke about last month. She called the property manager and explained the situation. He has since contacted me and advised me to write a letter to the board of the HOA explaining the circumstances.

    I wrote a letter to the board as I was advised by the property manager. However, on 8/31/17 I received an e-mail from the property manager stating that the board has denied my request to pay the towing expense for the jeep. It is my understanding that the management is the one who should be absorbing the costs as it was their mistake and not the HOA. I spoke with the towing company on 8/31/17 and they advised me that the Jeep would be sold on 10/05/2017 if it is not retrieved.

    My question is two-fold: Should I take this to small claims court & should I go and retrieve the vehicle on my own and attempt to be reiumbursed later?
