    Post Embezzlement Charges

    I recently found several checks in my husband's possession from his company bank account, signed with two signatures, but completely blank. Along with these checks were also some deposits slips to his personal checking account with very large sums of money being deposited, broken up into three small deposits all done within one to two minutes of each other on the same day.
    His spending habits have dramatically changed in the past year with him buying some rather high ticket items. Since we have separate checking accounts I have asked him on several different occasions where he was getting so much money. He always says either he saves a lot of money or he got a big bonus at work. After recently finding the above mentioned checks in his possession I am very concerned and worried that something "fishy" is going on. He works in the Accounts Payable dept. and has access to credit card accounts, checking accounts, etc. every day. I cannot confront him about this because I know he would not tell me the truth, but I need to know what I should do. I have considered the following options: 1) Calling his boss and asking him if it is normal to issue blank, signed checks to employees, 2) consulting an attorney. I really have no one I can discuss this with and I really need to know how I should go about finding out if he is doing something illegal, i.e. do I need more evidence or what? Just wondered if anyone has ever been in a similar situation and how they proceeded.

    If you call his boss and you're correct, there's a good chance he's going to end up being criminally charged. So you may wish to follow your other instinct and consult a lawyer.

    Thanks for your reply, Mr. Knowitall. What happens if I consult an attorney, which I would definitely prefer to do as opposed to calling his boss, but what will an attorney likely advise me to do? I am in the state of Alabama if that helps at all. I see you are in California. I have just never had to deal with anything of this magnitude and I would like to know what to expect, especially since I believe one of the signatures on the checks was forged by my husband (it suspiciously looks a lot like his handwriting) and the other one is a stamped signature, so that would mean he might be guilty of forgery also. If I consult an attorney and tell him/her all that I have found and it ends up my husband is guilty would he not be facing criminal charges going this route as well? Forgive me for these questions, but I have no idea what would be the course of action in a court of law for charges like embezzlement and forgery or if there would be some way around these if, indeed, this is what he is doing.

    Could anyone out there tell me what specific type of attorney I should consult about this matter with my husband? Also, what type of legal fees might I encounter for a consultation, etc?

    If you want to stay with your husband and help him through this, consider consulting a criminal defense lawyer. Otherwise, consider consulting a divorce lawyer.

    Whether I stay with him or divorce him, will our assets such as our house, cars and other personal property be subject to part of an embezzlement lawsuit? In other words, would I or we be subject to losing any of this property due to his embezzlement/forgery if he were, indeed, eventually convicted of such?
