    Default Using Marijuana During Pretrial Diversion

    My question involves criminal law for the state of: Illinois

    I was recently caught shoplifting a couple beers from a grocery store. Age 19, clean record up until now. I realize the stupidity of my decision and it's a mistake that I've definitely learned from. I recently had a court date and was offered pretrial diversion. I need to take a couple of behavioral assessment courses for my case to be dismissed.

    My question is regarding the possibility of a drug test. I've been an occasional marijuana smoker since high school and I smoked one night when I was out with friends before my court date. I didn't think much of it since small amounts have been decriminalized in Illinois and it's completely unrelated to my case. I don't plan on smoking anytime soon but how likely is it that I will be drug tested and if I were to fail, how would it effect my case since unless you're dealing or carrying large amounts it's civil offense at this point? (From my understanding, correct me if I'm wrong)

    Any help would be greatly appreciated. I'm currently in college studying political science and don't want to let one stupid mistake I made ruin my future prospects.

    It's possible you'd be tested, especially if the PO thinks you're dirty (and believe me, most can smell it on you). If you are found to be using illlegal drugs in violation of your diversion conditions, you'll find your case likely UNDIVERTED and you'll be heading towards a conviction, sentencing, and a criminal record.

    Don't SCREW AROUND. Seriously, unless you are some sort of sociopath, you can obey the law for the brief period it takes you to finish your diversion.

    Everything you do while on probation is related to your case. Or nearly everything. If you have to take a urinalysis and you come up hot, they will use that against you. When my ex was on probation he got sanctioned for not showing up to like three UA tests. He had to do 30 days in jail (well only sat 21 days). He was on probation for 2 years. He almost had his case revoked because he got arrested for another crime while on probation. If you are qualified for diversion don't mess it up.

    If you don't want to ruin your future stop stealing and stop doing drugs.

    But you haven't realized the stupidity of your second decision. You're playing with fire. If the weed is that important to you then you face potential future problems. If your future is more important to you then stop.
