You're going to have to make an attempt to find him. The court will, after you provide proof of a bona fide attempt to find the other party (and you just saying "he abandoned us" will not suffice), may allow service by publication. My question involves name change laws in the State of: Tennessee
My child's last name is her father's, he abandoned her two years ago, child support has been trying to track him down and hasn't been able to, he's apparently moved out of state. I provide for her and always have, she(my child) has asked for my last name. I cannot serve him for a name change, myself and the child support agency can't find him.
