What happens at a Gagnon II hearing?
After you're picked up on a probation violation, there is a hearing to determine if you should remain in custody while awaiting further proceedings on the probation violation case -- the Gagnon I hearing.
If you are not released, then you will be scheduled for a hearing within thirty days to determine whether or not you violated probation and, if so, if you should be resentenced and what your sentence should be -- that is the Gagnon II hearing.
