    Default Restrictions on Reselling Concert Tickets

    My question involves a consumer law issue in the State of: New Jersey

    I am concerned about reselling concert tickets of which I purchased through public sale online via Ticketmaster. The face value of the ticket is $145. I am not a licensed ticket broker. If my understanding is correct I can only resell the ticket at the greater of 20% of the face value, or $3, whichever is greater. So the most I could sell it for is $145 + $29 = $174? But I read that if the ticket is sold online there is no limit as to what I could resell it for.

    If I were to resell it on Ticketmaster, could I resell it for any amount? That is what I plan and hope to do.

    Please note I am not a scalper, nor am I trying to profit. This is my first concert and I bought multiple tickets because I was not sure which venue I would be able to attend due to time constraints.

    I appreciate if someone could clarify this matter for me further and if my understanding is correct.

    Yes, the scalping law applies to ticket brokers and selling at the venue. You can use ticketsnow to set any price they will allow.

    Here's the clarification:

    56:8-33 Price charged printed on ticket, maximum premium for reseller; exceptions.

    8. a. Each place of entertainment shall print on the face of each ticket and include in any advertising for any event the price charged therefor.

    b. No person other than a registered ticket broker shall resell or purchase with the intent to resell a ticket for admission to a place of entertainment at a maximum premium in excess of 20% of the ticket price or $3.00, whichever is greater, plus lawful taxes. No registered ticket broker shall resell or purchase with the intent to resell a ticket for admission to a place of entertainment at a premium in excess of 50% of the price paid to acquire the ticket, plus lawful taxes.

    c. Notwithstanding the provisions of subsection a. or b. of this section, nothing shall limit the price for the resale or purchase of a ticket for admission to a place of entertainment sold by any person other than a registered ticket broker, provided such resale or purchase is made through an Internet web site.
