My question involves landlord-tenant law in the State of: Florida
I live in Tallahassee, Florida. Eight years ago my mother died and left my sister and I her home. We are both listed as owners of the property. It is a site built home and has no mortgage.
When my mother died my sister recommended that in a bad real estate market we should rent the home to her son for taxes and insurance. I agreed.
Recently my son and his girlfriend had a baby and I agreed to rent them my home and I moved into the property my sister and I owned. Although I had previously checked with my nephew to see if it was OK to move in and he agreed, he immediately began to ask when I would be leaving. I told him I didn't plan on leaving and in jest asked him if he had a lease. He replied he did. I was shocked. Especially when I found out it was a life time lease (my sisters life time) executed by my sister.
My question is simple. Can my sister commit our jointly owned property to a life time lease to her son without my knowledge , agreement and signature?
