    Default Stealing from Work, Possibly Caught on Camera

    I stole from my job and may have been caught on camera. After I took the item I noticed a Loss Prevtion detective that seemed as if she was following me. The days thereafter almost everywhere I went LP was there. A whole week went pass and nothing happened. Them I took Medical Leave? It will be a full 2 months since the incident when I return. Do you think I was discovered? If so, can they still fire me when I come back from leave?

    No one here will have any better idea than you do whether the store discovered your theft. But if the store management did discover it you certainly may still be fired for it.

    I don't know whether you are thinking that you cannot be fired because the medical leave protects you, or because of the length of time since you stole. Rest assured that neither is true. SOME forms of medical leave protect you from being fired FOR BEING ABSENT FROM WORK but there is no form of leave you can take that will protect you from being fired because you stole. Neither is there any law that says if you haven't been fired after x amount of time the employer is thereafter barred from doing so. You're just going to have to keep on being scared until your employer makes it clear what he's going to do. There's certainly not any law that's going to protect you from being fired. Don't count on unemployment if you are. And, just so you know, your employer is allowed to tell prospective employers why you were fired, despite what you may have heard to the contrary.

    DAMN I get so tired of these pathetic thieves who don't have any qualms about taking what doesn't belong to them but then panic at the thought of actually having to suffer any consequences for it or own their own actions.

    It sounds to me like they did see you. They likely didn't immediately move on you because they wanted to see if you were going to do anything else, as well as going back and investigating to see if you did anything prior. It is entirely possible they could pull you when you return to work. Understand that being fired is not your only worry, Macy's does prosecute employee theft cases. It may be a hard sell with prosecutors since it will have been a long time since the theft but they can and do still try.

    Possibly they didn't move on you because they weren't sure but they were keeping their eye on you. I don't know why any retailer would retain anybody once they were known to be a thief. There several reasons that shouldn't be done. If you return to work, consider yourself on double-secret probation. Not only should you not steal or even do anything that looks like it, you should toe the line on every other employee policy and work ethic. They don't even need a reason to fire you, don't give them anything to encourage it.
