Ticket for Not Properly Displaying a FasTrak Transponder

My question involves a traffic ticket from the state of California. Does any one know the cost of a ticket for not properly displaying my Fas Trak transponder on my dash board? I had it in the car however the velcro keeps falling off due to the hot weather.

There is a number on the ticket, call it an ask for the amount.

Order a new set of velco pads from fastrac, get a bottle of rubbing alcohol and clean the surface that you want the velcro pad to stick to. The rubbing alcohol will take any dirt, oil and grime away making the sticky pad stick for a very long time.

It is hard to read the officers writing but it looks like Code 23302. Section may be 191 with another number or letter following it but I am unable to read it.

23302, which is the correct CVC for your violation as described, will cost you $238. There are no points assessed for this violation.

It's not supposed to be on the dashboard. It's supposed to be stuck to the windshield, preferably high and center (though the lower corners are acceptable as an alternate).

VC 23302 says:

if a transponder or other electronic toll payment device is used to pay tolls or other charges due, the device shall be located in or on the vehicle in a location so as to be visible for the purpose of enforcement at all times when the vehicle is located on the vehicular crossing or toll highway.

It does NOT need to be affixed. It shall be visible. I prop mine up against the lower driver side corner windshield when I need it

It's NOT incorrect. The Caltrans guidance tells you what to do with it for it to be functional. NOWHERE do they say STICK IT TO THE DASH.

Further, you blew off the phrase that follows "visible" in the code. You can't just say "it was visible" when it was not "visible for the purposes of enforcement." But go ahead, you know freaking everything. Have a nice day in court.

I dont care what caltrans says, caltrans is NOT THE LAW.

The LAW says it must be visible. It does not need to be affixed to anything. Just visible.

You can't concentrate on ONE word. The LAW is a sentence and you have to read the entire sentence. As I pointed out, it doesn't say "must be visible."
