My question involves landlord-tenant law in the State of: CA
To give some backstory, there are 3 other girls who are sharing this off-campus condo with me. One girl is a tenant who renewed the lease for July 1st, 2017 - June 30th, 2018. The other two girls are my friends who moved in July 1st. I moved in August 1st.
The girl who renewed the lease left mid-June for a summer internship so she was not aware of the condition her old roommates had left the place, until recently when we told her. We contacted our landlord about getting some kind of pest control for a possible spider infestation. She put the blame on the girl who renewed the lease. Our landlord claimed that it was from the trash that was left in the garage for the two weeks from mid-June to July 1st. However, this girl was not there at the time so the only ones to blame are the girl's old roommates.
The landlord wanted us to talk to the girl so she can fix this situation. A day later, the landlord told us she would call pest control. She never gave us a date. It's been about a week and we have noticed even more spiders than before. It's not just one spider, we see about 5-10 spiders a day in the living room and even more in the kitchen. This has been an issue since my friends have moved in on July 1st. We have taken pictures and documented all the bugs (mainly spiders) we have come across.
I have looked at our lease and it only states we are responsible for ants and fleas and that she would take care of the other insects. I was wondering what is an appropriate time frame to give the landlord enough time to fix the problem? If she doesn't help or postpone it, what can we do? I was thinking about calling a pest control company to get a free home inspection to show proof that there is a spider infestation, but I'm not sure what to do after that. Can I use this to break out of a lease (even though there are 4 of us who sign the lease)? Or can we pay for the pest control and sue her for the charges?
