    Default Can You Get Power of Attorney to Settle Somebody Else's Debts

    My question involves collection proceedings in the State of: Hawaii

    My daughter who is a young adult was previously living and working in Oahu, Hawaii for 1 1/2 years.

    While in Hawaii she was being treated by Dermatologist for an acne problem. The doctor prescribed Tretinoin. Anyone who is on the Tretinoin regiment, the patient is required to have periodic blood tests. So, after several laboratory tests she owed a balances since she had not met her annual deductible. No problem.

    However, the laboratory was sending their billing statements to the apartment address she was residing but none of her roommates had a mailbox key to access any mail because most of them receive mail at their permanent address on the mainland including my daughter. Except for insurance and medical purposes she uses her Hawaii address.

    Yes, she is a big girl and should have realized she owed money for the unpaid bills but she figured everything was covered by her insurance company. So, she never received their statements which she wasn't aware she had. No big deal.

    Since the statements were never paid the laboratory has since sent the debt to their collection agency. She had received several periodic collection agency telephone calls which she avoided acknowledging being the debtor. Again, no big deal.

    Today, I called the collection agency attempting to either negotiate settling the debt or pay the balance of $596.66. She has the money to pay off the debt
    immediately.

    Anyway, the assigned collector stated he could not speak with me because I was not the debtor. Although, he said if I gave him a credit or debit card he'd be able to clear the balance right now for me. I told him not to be a stupid collector, I'm not giving you a credit / debit card number over a telephone call.
    Naturally he hung up. Again, no big deal. Naturally, when I called back the collector had stepped out of the office. No big deal.

    So, my call was then forwarded to a manager who went through the same comment about not being able to speak with me because I'm not the debtor which is based upon FDCPA. I told him good suit yourself and this debt will simply go unpaid and you can continue attempting to collect the debt and wished him good luck trying to figure out where my daughter is living.

    Anyway, so the question is: Can my daughter sign and mail a Limited Power of Attorney to their office granting me authority to act on her behalf to either negotiate or settle this debt on her behalf without the Collection Agency violating FDCPA? If not or they won't accept it Oh well no big deal.

    Your daughter is an adult, and she has the money, so why doesn't she pick up the phone and negotiate her own settlement?

    Even if she were to send them power of attorney, we can't promise you that they'll choose to discuss the debt with you or negotiate with you.
